There are two types of custody regarding which you’ll need to reach decisions.

Legal custody is the decision-making power over life decisions such as education and medical decisions and equal access to school records.

Physical custody is where the child or children will live. The physical custody is usually one of these two arrangements:

  • Split physical custody – one child goes to one parent and another child goes to the other parent
  • Sole or Primary custody – the child or children live with one parent the majority of the time and visit the other parent. Visitation must be reasonable and is usually every other weekend, two weeks of vacation time, one dinner per week and alternating holidays.
